What is a Statement of Use?
A statement of use is a verified statement that the mark is in use in commerce and specifying the date of the applicant’s first use of the mark in commerce, and those goods or services in connection with which the mark is used in commerce. A statement of use, is accompanied by evidence of use (proof that your are selling the specific goods or services that you included in your trademark application. There are filing fees that must be paid in order to submit a statement of use; and the statement of use application is subject to examination and approval by the United States Trademark Office.
Need More Time to Submit Statement of Use?
If you need more time to submit your statement of use, because you are not yet using the trademark in commerce on all the goods and/or services listed in your trademark application, you must timely file an extension request and pay the required fees to avoid your application abandoning. Because each granted extension request lasts only six months, you must continue to file extension requests every six months, during an unexpired extension period. You can file a total of five extension requests. You must file the first request within six months of that date that the trademark requested your statement of use and you must file all subsequent requests before the expiration of a previously granted extension. This must be done within 30 months of the date of the first extension request,
What Happens After I Timely Submit my Statement of Use?
Once you timely file your statement of use, if the trademark office accepts it, the mark shall be registered in the Patent and Trademark Office, a certificate of registration shall be issued for those goods or services recited in the statement of use for which the mark is entitled to registration, and notice of registration shall be published in the Official Gazette of the Patent and Trademark Office.
